ARCA General Resolution No. 5907/2026: Regulations Governing the Labor Assistance Fund (FAL)
By Javier Fernández Verstegen, Partner at Brons & Salas.

On October 1, 2026, General Resolution No. 5907/2026 was published, whereby ARCA (the Argentine Tax Authority) regulated the procedure for the assessment and payment of the amounts intended for the Labor Assistance Fund (Fondo de Asistencia Laboral or FAL), established by Labor Modernization Law No. 27,802.
Below is a brief summary of the main provisions of the Resolution.
- A. Before filing the return assessing the employers’ and employees’ contributions due to the social security system (Form 931) for the November 2026 accrual period, employers must access the “Simplificación Registral” service [Simplified Registration Service] and inform whether they belong to the private or public sector.
- B. Before processing the filing of Form 931 for November 2026, the employer must have selected an FAL and obtained the relevant FAL ID. Employers must report and validate the FAL ID assigned to their Individual Employer Account through the Mi Simplificación platform. To do so, they must validate the information related to the application to open the Individual Employer Account before the Authorized Entity.
- C. The FAL contribution payable as from November 2026, inclusive, will be included in the balance resulting from the return assessing the employers’ and employees’ contributions due to the social security system (Form 931). Payment must be made on the same due date established for the other items comprising such obligations, by means of an Electronic Payment Voucher (VEP), using the following code: Impuesto/concepto/subconcepto (ICS) 266-019-019 – Fondo de Asistencia Laboral.
- D. If the employer fails to report its FAL ID, ARCA will notify the Argentine Securities Commission (Comisión Nacional de Valores or CNV) so that it can assign an ID on its own initiative and allocate the relevant FAL contribution. Until the CNV makes such assignment, the FAL contribution will remain unallocated.
- E. The FAL contribution shall be calculated on the same remuneration base used to calculate contributions payable to the Integrated Retirement and Pension System (SIPA). The applicable rates are 2.5% for SMEs and non-profit entities, and 1% for all other private-sector employers.
- F. The so-called “Declaración en línea” system [Online Filing System] will automatically calculate the monthly contribution to the FAL, which will be deducted from the employer’s contributions to the Social Security System. The system will calculate the revised employer’s contribution rates and automatically display the amount resulting from the sum of all amounts, including a new line item under “Grand Totals” on the “Calculation Result” screen.
- G. The funds contributed by each employer will be transferred by ARCA to the collective investment vehicle associated with the FAL ID reported by the employer or assigned by the CNV in the absence of an employee-reported FAL ID.
- H. If any regime for the reduction of employers’ contributions applies, such reductions will not affect the calculation of the contribution payable to the FAL. Please note that employees covered by the Labor Training Incentive Regime (Régimen de Incentivo a la Formación Laboral or RIFL) are not subject to the FAL.
At Brons & Salas, we remain available to provide any further clarification or additional information regarding the matters affected by these regulations.
