La Inspección General de Justicia crea el Sistema Online de Documentación Abierta

En el día de hoy se publicó en el BO (Boletín Oficial) la Resolución General 7/2026 de la Inspección General de Justicia (IGJ), mediante la cual se crea el Sistema Online de Documentación Abierta de IGJ, una nueva plataforma para la tramitación digital de actuaciones ante la Inspección General de Justicia, con el objetivo de profundizar la «despapelización» y simplificar los procedimientos registrales y de fiscalización.

Principales novedades

1. Creación del Sistema Online de Documentación Abierta

Se establece un sistema único para la recepción, tramitación y gestión digital de los trámites ante la IGJ. Las presentaciones realizadas por este medio tendrán los mismos efectos jurídicos que las efectuadas en soporte papel.

2. Presentaciones exclusivamente digitales

Se modifica el artículo 5° del Anexo A de la RG IGJ 15/2024 para disponer:

El acceso al sistema se realizará desde el sitio web oficial de la IGJ.
La autenticación se efectuará mediante Clave Fiscal ARCA nivel 3 o superior.
Dicha autenticación funcionará como firma electrónica en los términos de la Ley 25.506.
Toda la documentación presentada tendrá carácter de declaración jurada, siendo el presentante responsable por su autenticidad e integridad.

3. Implementación gradual

La digitalización no será inmediata para todos los trámites:

• La incorporación al sistema será progresiva.
• La IGJ determinará qué trámites se habilitan en cada etapa.
• Mientras un trámite no sea incorporado, continuará utilizando el mecanismo actualmente vigente.

4. Expediente electrónico y notificaciones

El nuevo artículo 6° del Anexo A de la RG IGJ 15/2024 establece que:

• El formulario de actuación será generado automáticamente por el sistema.
• Cada presentación originará un expediente electrónico, que constituirá el repositorio oficial de la documentación.
• Las notificaciones se cursarán al domicilio electrónico constituido y tendrán los mismos efectos que una notificación personal o por cédula.

5. Delegación para dictar instructivos

La resolución faculta a las Direcciones y Jefaturas de Departamento de la IGJ a emitir instructivos y normas operativas para:

• Definir requisitos técnicos.
• Establecer formatos de archivos y estándares de seguridad.
• Regular aspectos procedimentales no previstos expresamente en la normativa.

Vigencia

La resolución entra en vigencia el 2 de julio de 2026. Sin embargo, la utilización obligatoria del sistema para cada trámite dependerá del cronograma de implementación que establezca la propia IGJ.

Impacto práctico

La RG 7/2026 implica:

• La consolidación de la despapelización de los trámites ante la IGJ.
• La equiparación jurídica entre documentos digitales y soporte papel.
• La utilización de la Clave Fiscal como mecanismo de autenticación y firma electrónica.
• La creación de expedientes íntegramente electrónicos.
• Una mayor agilidad y simplificación administrativa para sociedades y entidades sujetas al control del organismo

The General Inspection of Justice Creates the «Open Documentation Online System»

Today, General Resolution 7/2026 of the General Inspection of Justice (IGJ) was published in the Official Gazette (BO). This resolution creates the IGJ’s Open Documentation Online System, a new platform for the digital processing of proceedings before the General Inspection of Justice, aimed at advancing the «paperless» initiative and simplifying registration and oversight procedures.

Key Innovations

1. Creation of the Sistema Online de Documentación Abierta

A single system is established for the digital receipt, processing, and management of procedures before the IGJ. Filings made through this system will have the same legal standing as those submitted in paper format.

2. Exclusively Digital Filings

Article 5 of Annex A of RG IGJ 15/2024 is amended to establish the following:

• Access to the system will be through the official IGJ website.
• Authentication will be carried out using an ARCA Fiscal Code (Clave Fiscal) level 3 or higher.
• This authentication will function as an electronic signature under the terms of Law 25,506.
• All submitted documentation will hold the status of an affidavit (declaración jurada), and the submitter will be held responsible for its authenticity and integrity.

3. Gradual Implementation

Digitalization will not be immediate for all procedures:

• Integration into the system will be progressive.
• The IGJ will determine which procedures are enabled during each stage.
• As long as a procedure has not been integrated, it will continue to use the mechanism currently in place.

4. Electronic Records and Notifications

The new Article 6 of Annex A of RG IGJ 15/2024 establishes that:

• The filing form will be automatically generated by the system.
• Each filing will initiate an electronic record (expediente electrónico), which will serve as the official repository for the documentation.
• Notifications will be sent to the registered electronic address (domicilio electrónico) and will have the same legal effect as a personal notification or a formal subpoena.

5. Delegation to Issue Guidelines

The resolution authorizes the Directorates and Department Heads of the IGJ to issue guidelines and operational rules to:

• Define technical requirements.
• Establish file formats and security standards.
• Regulate procedural aspects not explicitly foreseen in the regulations.

Effective Date

The resolution comes into effect on July 2, 2026. However, the mandatory use of the system for each specific procedure will depend on the implementation schedule established by the IGJ itself.

Practical Impact

RG 7/2026 entails:

• The consolidation of paperless procedures before the IGJ.
• The legal equalization of digital documents and paper formats.
• The use of the Fiscal Code (Clave Fiscal) as a mechanism for authentication and electronic signature.
• The creation of entirely electronic records.
• Greater agility and administrative simplification for companies and entities subject to the agency’s oversight.
