El pasado 29 de julio de 2026 se publicó en el Boletín Oficial de la Ciudad Autónoma de Buenos Aires la Resolución N° 852/SECTE/2026, mediante la cual la Secretaría de Trabajo y Empleo de la Ciudad Autónoma de Buenos Aires dispuso dejar sin efecto la obligación de rúbrica de la documentación laboral prevista en el artículo 52 de la Ley de Contrato de Trabajo en la Ciudad de Buenos Aires. La obligación cesa con efectos retroactivos al 1 de junio de 2026.

Recordamos que la Ley de Modernización Laboral N° 27.802 modificó la normativa y estableció que el cumplimiento de las obligaciones previstas por el artículo 52 de la Ley de Contrato de Trabajo se acredita con el alta y baja de los trabajadores en los sistemas habilitados por ARCA, resultando ello suficiente a todos los efectos legales.

Asimismo, la normativa dispuso que ya no será exigible a los empleadores llevar libros laborales en soporte físico ni digital.

En este contexto, la Resolución mencionada adecúa la normativa a las disposiciones de la Ley 27.802

Payroll Book under Section 52 of the Labor Contract Law – The City of Buenos Aires Abolishes Certification Requirements

On July 29, 2026, Resolution No. 852/SECTE/2026 was published in the Official Gazette of the City of Buenos Aires. Pursuant to this Resolution, the Secretariat of Labor and Employment of the City of Buenos Aires abolished the requirement to certify payroll records under Section 52 of the Labor Contract Law in the City of Buenos Aires, with retroactive effect as of June 1, 2026.

It should be recalled that Labor Modernization Law No. 27,802 amended the applicable regulations, establishing that the registration and deregistration of employees in the systems provided by the Argentine Tax Authority (ARCA) are now sufficient to evidence compliance with the provisions of section 52 for all legal purposes.

Consequently, employers are no longer required to maintain payroll books in either physical or digital format.

Resolution No. 852/SECTE/2026 brings the local regulations into line with the provisions of Law No. 27,802.
